Welcome to Hearsay, Inc.! These Terms of Service ("Terms") govern your access to and use of our website located at heardotsay.com (the "Site"), our physical brewery location, and any other services we offer (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. Please read them carefully.  

1. Acceptance of Terms

By accessing or using the Services, you represent and warrant that you are of legal drinking age in your jurisdiction and that you agree to these Terms. If you do not agree to these Terms, do not access or use the Services.  

2. Services

We offer a variety of Services, including but not limited to:

  • Providing information about our brewery, beers, and events.

  • Selling beer, food, and merchandise online and at our physical location(s).

  • Hosting events and promotions.

  • Operating a loyalty program.

We reserve the right to modify or discontinue any aspect of the Services at any time without notice.

3. User Conduct

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Services in any way that violates any applicable federal, state, local, or international law or regulation.  

  • Impersonate or misrepresent your affiliation with any person or entity.

  • Interfere with or disrupt the operation of the Services or the servers or networks connected to the Services.  

  • Attempt to gain unauthorized access to any part of the Services or any other systems or networks.  

  • Use the Services to transmit or distribute any viruses, worms, or other malicious code.

  • Use the Services to collect or track the personal information of others.

  • Engage in any conduct that could damage, disable, overburden, or impair the Services.

4. Purchases

If you purchase any products or services through the Services, you agree to pay the applicable fees and taxes. All sales are final. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product descriptions, or suspected fraud. For alcohol purchases, you must be of legal drinking age and provide valid identification at the time of purchase or delivery.  

5. Intellectual Property

All content included on the Services, such as text, graphics, logos, images, and software, is the property of Hearsay, Inc. or its licensors and is protected by copyright and other intellectual property laws. You may not use any content from the Services without our prior written consent.  

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.  

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.  

8. Indemnification

You agree to indemnify and hold harmless Hearsay, Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses (including attorneys' fees) arising from your use of the Services or your breach of these Terms.  

9. Governing Law

These Terms will be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.  

10. Dispute Resolution

Any disputes arising from or related to these Terms or the Services will be resolved through binding arbitration in the courts of Michigan.

11. Changes to Terms

We reserve the right to modify these Terms at any time without notice. Any changes will be posted on this page with a revised "Effective Date." Your continued use of the Services following the posting of changes constitutes your acceptance of the revised Terms.
